Terms and Conditions

Advertisers on TasmanianJobs.com (Website) agree to be bound by the following terms and conditions:

  1. Advertising
    1. Advertisers acknowledge and agree that TasmanianJobs.com acts as a medium through which individuals or organisations identify employment and training opportunities and that TasmanianJobs.com does not and will not and nor is it responsible for vetting users or the representations made by them, whether oral or in writing.
    2. Advertisers must be registered with TasmanianJobs.com in order to post an advertisement on the Website.
    3. Advertisers must ensure that an advertisement is posted to the appropriate category of the Website and the onus is on Advertisers to ensure that they familiarise themselves with the advertising requirements of each available category on the Website to ensure appropriate placement of advertisements.
    4. TasmanianJobs.com reserves the right in its absolute discretion, and Advertisers must accept as a condition of advertising on the Website, TasmanianJobs.com's right to re-classify advertisements posted to the Website and to withdraw advertisements from one category of its Website and to re-publish in another category of the Website.
    5. Advertisers agree not to require any user to pay a fee, charge, cost or any money whatsoever to enquire, apply or submit for any job or training course advertised on the Website whether such fee, charge, cost or money is asked or required of the candidate in the job advertisement itself or in any communication with the candidate that takes place as a result of a job advertisement placed on the Website.
    6. Advertisers may not advertise the following types of advertisements:
      • Jobs or training that are not located in Tasmania, Australia;
      • Pyramid, multilevel marketing or other commission jobs, which do not involve the sale of a legitimate product or service;
      • Advertisements that attempt to collect personal information and contact details for potential future purposes eg register or database collection rather than a specific job vacancy or training course;
      • Jobs or training that do not provide full details of the product or services involved; or
      • Jobs or training involving activities, products or services which may be considered offensive or illegal.
    7. Advertisers agree to use the Website for lawful purposes only.
    8. Once an advertisement is submitted by Advertisers, the content can not be edited by Advertisers. Advertisers may request TasmanianJobs.com to amend, alter or remove a posted advertisement from the website which TasmanianJobs.com will do as soon as is reasonably practicable provided such amendment, removal or alteration does not otherwise breach this agreement.
    9. Advertisers warrant and represent to TasmanianJobs.com that s/he has obtained all necessary and relevant consents and approvals from any party who may hold intellectual or other property rights in the advertisement to be posted on the Website and agrees to indemnify, release and hold harmless TasmanianJobs.com in respect to any damage or loss suffered in consequence of a breach of such warranty or representation.
  2. Process
    1. TasmanianJobs.com will undertake an approval process for every advertisement posted to its Website. Once approved, the Advertiser will be invoiced in accordance with Section 5 herein. In some circumstances, TasmanianJobs.com may require pre-payment for advertising.
    2. TasmanianJobs.com reserves the right to reject or remove any advertisement without notice that does not appear to comply with the law, the factors outlined in Section 1.6 or is otherwise in breach of this agreement. Further, TasmanianJobs.com reserves the right to reject or remove any advertisement from its Website for any reason whatsoever.
    3. TasmanianJobs.com agrees to use reasonable efforts to approve and publish advertisements within a 24-hour business day period from when the job advertisement email is received by TasmanianJobs.com. Advertisements to be approved and published for Friday and weekend posting on the website must be submitted by 11am Australian Eastern Standard Time (AEST) on Fridays. TasmanianJobs.com is not liable for any loss or damage incurred by a Advertiser as a result of any failure or delay in listing a job advertisement within a 24 hour business day period as specified herein.
  3. Resume Database
    1. Users of the Resume Database must be registered as Advertisers with TasmanianJobs.com in order to download resumes from the Resume Database.
    2. Advertisers acknowledge and agree that TasmanianJobs.com acts as a medium through which individuals are able to upload their resume/curriculum vitae with the view to be directly contacted by potential employers and that TasmanianJobs.com does not and will not and nor is it responsible for vetting members or resumes or the representations made by them, whether oral or in writing.
    3. Each individual resume download will be charged at $100.00, inclusive of GST and all other duties or taxes unless otherwise specified.
    4. Resumes will be emailed to registered Advertisers and stored in the Advertisers account with TasmanianJobs.com.
  4. Legal Requirements
    1. Without limiting the generality of Section 3.3 herein, as a condition of using any services supplied by TasmanianJobs.com, Advertisers must comply with all applicable legislation, regulations, by-laws, ordinances and codes of conduct including but not limited to the Anti Discrimination Act 1998 (Tas), Disability Discrimination Act 1992 (Cmth), Equal Opportunity for Women in the Workplace Act 1999 (Cmth), Human Rights and Equal Opportunity Commission Act 1986 (Cmth), Racial Discrimination Act 1975 (Cmth), Sex Discrimination Act 1984 (Cmth) and all other applicable anti-discrimination and equal opportunity legislation.
    2. Advertisers must ensure that all advertisements posted on the Website comply with all applicable legislation, regulations, by-laws, ordinances and codes of conduct, including, but not limited to the Trade Practices Act 1974 (Cmth), the Fair Trading Act 1990 (Tas) in Tasmania and any other relevant jurisdiction.
    3. Advertisers agree to comply with the National Privacy Principles (http://www.privacy.gov.au/act/npps/index.html) set out under the Privacy Amendment (Private Section) Act 2000 which the Advertiser acknowledges having previously read and understood.
    4. Advertisers agree to comply with Section 53B of the Trade Practices Act 1974 (C'th) which requires that Advertisers that are companies not mislead persons seeking employment as to the availability, nature, terms or conditions, or any other matter relating to the employment opportunity being offered.
  5. Rates and Taxes
    1. Each individual advertisement will be charged at $125, inclusive of GST and all other duties or taxes unless otherwise specified.
    2. In some circumstances, TasmanianJobs.com may require pre-payment for advertising.
    3. TasmanianJobs.com will invoice Advertisers immediately an advertisement is posted and approved. TasmanianJobs.com does not provide for credit card payment.
    4. AdPack rates are provided on the AdPack page in the Website.
    5. Tailored packages of advertisements may be discussed with TasmanianJobs.com, refer section 6.
    6. AdPack contracts will be invoiced from the date of application.
    7. Advertisers understand and agree that the following actions constitute a new/additional advertisement under this agreement;
      • Reposting on the website a previously advertised job or training course;
      • Extending the advertisement longer than the initial advertisement period.
      A new, re-advertised or extended advertisement will be billed as such.
    8. Each individual resume downloaded from the Resume Bank webpage will be charged at $100, inclusive of GST and all other duties or taxes unless otherwise specified.
    9. TasmanianJobs.com may vary advertising and resume download rates and the terms and conditions of these Terms and Conditions at any time without notice. Posting them on the Website will be deemed to be sufficient notice to Advertisers of such changes.
    10. TasmanianJobs.com will provide Advertisers with a tax invoice in a compliant form for GST purposes.
    11. TasmanianJobs.com reserves the right to refuse further advertising or resume downloads by an Advertiser if any invoice previously sent to an Advertiser remains or has remained outstanding for a period of longer than 30 days.
  6. Payment
    1. All amounts owing to TasmanianJobs.com (ABN 24 484 507 481) by Advertisers must be paid within 14 days of the date of invoice notwithstanding any errors or omission in any job advertisement placed on the TasmanianJobs.com Website.
    2. TasmanianJobs.com will charge Advertisers late fees on payments over due by 30 days or more of $30 per advertisement unless otherwise waived in writing by TasmanianJobs.com.
    3. TasmanianJobs.com reserves the right to refuse the publication or listing on the Website of all or any advertisements for an Advertiser that has an outstanding debt with TasmanianJobs.com.
    4. TasmanianJobs.com will take proceedings against an Advertiser for any outstanding amounts, and will seek to recover from the Advertiser all costs relating to any action taken by TasmanianJobs.com to recover amounts owing for advertising or resume downloads, including without limitation, any mercantile agency costs and legal costs on a full indemnity basis. TasmanianJobs.com will cease publication of any further advertising or resume downloads on behalf of the Advertiser and terminate any agreement, or AdPack in relation to advertising not yet posted on the Website.
  7. AdPacks
    1. TasmanianJobs.com offers Advertisers multiple ad AdPack contracts as outlined in the AdPack information page on the Website.
    2. AdPack contracts will be invoiced from the date of application and must be paid in full on or before the date of first advertisement on the Website.
    3. AdPacks are valid for a period of six (6) months from the date of the first advertisement.
    4. Advertisers may negotiate a tailored AdPack contract with TasmanianJobs.com by contacting TasmanianJobs.com directly.
  8. Errors
    1. TasmanianJobs.com provides no warranty to Advertisers that the services generally available through the Website will be uninterrupted or error free. TasmanianJobs.com agrees to use its reasonable endeavours to ensure that any disruptions to or a denial of access to its Website will be remedied as quickly as possible.
    2. TasmanianJobs.com makes every effort to avoid errors in advertisements it has agreed to post on the Website. However, TasmanianJobs.com accepts no responsibility or liability for any errors and requires that Advertisers check their advertisements for errors as soon as they are approved by TasmanianJobs.com.
    3. All reasonable effort will be undertaken by TasmanianJobs.com to edit errors brought to TasmanianJobs.com's attention as soon as reasonably possible.
  9. Liability
    1. To the full extent permitted by the law, TasmanianJobs.com disclaims all liability for any loss, costs, damages or loss of profits sustained as a consequence of any Advertiser engaging any person, business or organisation sourced through the TasmanianJobs.com Website or for any costs, damage or loss which Advertisers may directly or indirectly suffer in connection with a Advertiser's use of the Website, nor does TasmanianJobs.com accept responsibility for any loss arising out of a Advertisers use or reliance on information contained on or accessed through the Website.
    2. Advertisers agree to indemnify and keep indemnified TasmanianJobs.com (even beyond the expiration of this agreement), its owners, officers contractors and employees, against all claims, actions, suits, liabilities, costs and expenses incurred howsoever by TasmanianJobs.com as a result of the posting or proposed posting of any advertisement by a Advertiser on the Website.
    3. TasmanianJobs.com cannot and does not guarantee or warrant to the Advertiser that files available for downloading through the Website or delivered via electronic mail through the Website will be free of infection or viruses, worms or other codes that manifest in contaminating or destructive properties. Advertisers are responsible for implementing sufficient procedures and checkpoints to satisfy their particular requirements for accuracy of data input and output and for maintaining a means external to the Website for the reconstruction of the data.
    4. Advertisers agree to keep TasmanianJobs.com, its owners, officers, contractors and employees fully indemnified against any action or contingent costs, expenses, charges, damages or liabilities incurred in relation to any actions or claims brought by any person or entity against TasmanianJobs.com as a result of an action or alleged breach by an Advertiser of any law, regulation, by-law, ordinance or code of conduct or such other actions or claims brought as a consequence of a Advertiser's advertisement appearing on the Website.
    5. To the extent permitted by the law, any condition or warranty which would otherwise be implied into these Terms and Conditions is hereby excluded.
    6. Advertisers acknowledge that TasmanianJobs.com is a distributor, not a publisher, of content on this Website. TasmanianJobs.com's editorial control is limited to the selection of materials to make available. Any opinions or advice by third parties remain the responsibility of those third parties and TasmanianJobs.com does not guarantee the accuracy, completeness or usefulness of that content or its fitness for any particular purposes.
  10. General
    1. Advertisers agree at all times to deal with any information or services provided by TasmanianJobs.com or accessed from the Website in a manner which abides by all applicable laws of Australia, Tasmania and any other relevant jurisdiction, including without limitation, privacy and copyright laws.
    2. Advertisers agree that pursuant to Sections 18K(1)(b) and 18N(1)(b) of the Privacy Act 1988, TasmanianJobs.com may for the purposes of assessing an Advertiser's commercial credit application, obtain from either a credit reporting agency or other credit providers, personal credit information about the Advertiser and/or its directors.
    3. Advertisers agree that pursuant to Section 18K(1)(h) of the Privacy Act 1988, TasmanianJobs.com may obtain a consumer credit report about the Advertiser from a credit reporting agency for the purposes of collecting overdue payments relating to commercial credit owed by the Advertiser.
    4. Advertisers agree that TasmanianJobs.com retains all intellectual property rights contained in all goods and services provided to you by TasmanianJobs.com.
    5. TasmanianJobs.com will not be liable for any delay or failure to publish a job advertisement on the Website caused by a factor outside TasmanianJobs.com's reasonable control (including but not limited to any Act of God, war, electricity failure, governmental or legal constraint).
    6. Users can contact Advertisers by email using a form on the website which does not display the Advertiser's email address. If an Advertiser places their email address in an advertisement TasmanianJobs.com cannot guarantee that the email address will not be recorded by a third party and used for broadcast unsolicited email (spam).
    7. TasmanianJobs.com will endeavour to reasonably investigate complaints during normal office hours, 9am - 5pm, Monday to Friday, AEST, excluding public holidays.
  11. Access to Website
    1. For the purposes of accessing and using the Website, and using the relevant access method, TasmanianJobs.com grant to you a non-exclusive, non-transferable personal licence in relation to the software, including any files, images, tables and data incorporated in or generated by the software, and data accompanying the software (collectively, the "Software") necessary for the purposes of a Advertiser's use of the Website. TasmanianJobs.com does not transfer title to nor grant any interest in the Software to Advertisers.
    2. Access to the Website may be terminated at anytime by Tasmanian.Jobs.com without notice. The disclaimers contained herein will nevertheless survive any such termination.
  12. Copyright

    Copyright in this Website (including text, graphics, logos, icons, sound recordings and software) is owned or licensed by TasmanianJobs.com unless otherwise provided. Information procured from a third party may be the subject of copyright owned by that third party. Other than for the purposes of, and subject to the conditions prescribed under, the Copyright Act 1968 (Cth) and similar legislation which applies in Tasmania, and except as expressly authorised by these Terms and Conditions, Advertisers may not in any form or by any means:

    1. adapt, reproduce, store, distribute, print, display, perform, publish or create derivative works from any part of this Website; or
    2. commercialise any information, products or services obtained from any part of this Website;

    without TasmanianJobs.com's written permission or, in the case of third party material, from the owner of the copyright in that material.

  13. Trade Marks
    1. Except where otherwise specified, any word or device to which is attached the ™ or ® symbol is a registered trade mark.
    2. If an Advertiser uses any of TasmanianJobs.com's trade marks in reference to TasmanianJobs.com's activities, products or services, TasmanianJobs.com must include a statement attributing that trade mark to TasmanianJobs.com. TasmanianJobs.com will not use any of TasmanianJobs.com's trade marks:
      1. in or as the whole or part of a Advertiser's own trade marks;
      2. in connection with activities, products or services which are not TasmanianJobs.com;
      3. in a manner which may be confusing, misleading or deceptive;
      4. in a manner that disparages TasmanianJobs.com or its information, products or services (including this Website).
  14. Linked Web Sites
    1. This Website may contain links to other web sites ('linked web sites'). Those links are provided for convenience only and may not remain current or be maintained.
    2. TasmanianJobs.com is not responsible for the content or privacy practices associated with linked web sites.
    3. TasmanianJobs.com links with linked web sites should not be construed as an endorsement, approval or recommendation by TasmanianJobs.com of the owners or operators of those linked web sites, or of any information, graphics, materials, products or services referred to or contained on those linked web sites, unless and to the extent stipulated to the contrary.
  15. Severability

    If any provision of this agreement is held invalid, unenforceable or illegal for any reason, this agreement shall remain otherwise in full force apart from such provision which shall be deemed deleted.

  16. Non Merger

    No provision of this agreement shall merge on or by reason of termination of this agreement.

  17. Non Waiver

    No failure to exercise and no delay in exercising any power or right conferred upon TasmanianJobs.com by this agreement shall operate as a waiver, nor shall any single or partial exercise of any power or right preclude any other or further exercise of such power or right or the exercise of any other power or right.

    1. This agreement is governed by the laws of Tasmania. Advertisers irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of Tasmania, and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum.
